The Legislature passed ESSB , a bill expanding overtime protections to all agricultural employees, including agricultural piece-rate employees, with a phase-in schedule that will last three years. Dairy workers are entitled to receive overtime effective immediately. Agricultural employees have historically been exempt from receiving overtime pay under the State Minimum Wage Act.
Agricultural employees will be entitled to receive overtime pay starting Jan. Each year, the phase-in schedule gradually reduces the number of hours employees need to work in a workweek to receive overtime pay. The department will investigate all received complaints. Dairy workers cannot file claims for overtime hours worked prior to Nov. Employees must be paid for all work perform at the rate agreed upon with their employer. This rate can be an hourly wage, salary, flat rate, piece rate, commission, etc.
When an employee is paid hourly, they must be paid for all hours worked. In some cases, meal periods may also be considered hours worked. Employees cannot volunteer to work for for-profit companies without pay. Regardless of how an employee is paid, their rate of pay must be at least the current state minimum wage.
And most employees working more than 40 hours per week must be paid overtime. Employees and employers may come to agreements related to payment that are more favorable than state law. This can include shift differentials, hazard pay, double time on holidays, on-call pay, etc. The agreed wage must be included in any overtime calculation when overtime-eligible employees work more than 40 hours per week. Employers are not required to give employees pay raises, unless the employee is paid minimum wage and the minimum wage is increased.
Food Preparation and Serving Related Occupations. Building and Grounds Cleaning and Maintenance Occupations. Office and Administrative Support Occupations. Farming, Fishing, and Forestry Occupations. No such report shall be required if notice of the modification is published after bid opening.
All actions modifying a general wage determination shall be effective with respect to any project to which the determination applies, if notice of such actions is published before contract award or the start of construction where there is no contract award , except as follows: In the case of contracts entered into pursuant to competitive bidding procedures, a modification, notice of which is published less than 10 days before the opening of bids, shall be effective unless the agency finds that there is not a reasonable time still available before bid opening to notify bidders of the modification and a report of the finding is inserted in the contract file.
A copy of such report shall be made available to the administrator upon request. The date that the rates are published, is the date they are effective for all projects that have not yet opened for bids. We will make every possible effort in getting the most current wages into our projects, without delaying the bid opening.
